The Constitutional Law of the Republic of Latvia on Latvia’s Independence
Aug. 21, 1991
Being aware of its responsibility to the people, and taking into
consideration its declaration "On the Renewal of the Independence of the
Republic of Latvia" adopted on May 4, 1990, and the results of the
all-Latvia advisory vote held on March 4, 1991, and the fact that on
August 19, 1991, as a consequence of the coup, constitutional structures of
state power and government of the USSR have ceased to exist, Article 9 of
the Declaration of the Independence of the Republic of Latvia, adopted on
May 4, 1990 on the restoration of the Republic of Latvia’s independent
statehood by way of negotiations cannot be implemented.
The Supreme Council of the Republic of Latvia therefor resolves:
1. To declare Latvia as an independent, democratic republic, in which the
sovereign power of the Latvian State is possessed by the people of Latvia
and its international judicial status is determined by the Republic of
Latvia by the Republic of Latvia’s constitution of February 15, 1922.
2. To repeal Article 5 of the declaration "On the Renewal of the
Independence of the Republic of Latvia" defining the transition period for
the de facto restoration of the state power.
3. Until the time when the occupation and annexation of Latvia is liquidated
and the parliament (Saeima) of the Republic of Latvia is convened, the
supreme power is completely to be executed by the Supreme Council of the
Republic of Latvia. Only the laws and resolutions of this supreme state
power are legally in effect in the territory of the Republic of Latvia.
4. The constitutional law is in effect upon its adoption.
